We have purchased a house and lot in 2019. No reservation fee and no documents for agreement or CTS was given. We have fully paid for 48mos of equity and have receipts for this. In the year 2022, we were asked to process loan form pagibig though no house was built yet and no proper explanation from the developer as to why we need to get the loan or the pros and cons of this loan. Pagibig did not approve but they made us sent letter of extension, and so on 2023 the loan but for LOT only was taken out first. It was only on 2024 that they updated us that they started the construction of the house. The TCT was given around 2023 and dates were on the year 2022. We have completed paying the equity on the year 2024, unfortunately, for some unforeseen circumstances, we will not be able to continue purchasing the house, so we decided to cancel it. We were asking for refund pursuant to Maceda Law.
1.Are we qualified for it?
2.we were not given CTS, and the developerโs LTS used for the subdivision was from the previous developer foreclosed unit, yet we cannot see it in DHSUD website nor in Ren.ph Does this qualify us for a full refund?
- We had conference with DHSUD and the developer committed to giving us a refund but are no longer responsive. Should we just proceed to HSAC?
